Terms of Service

These Terms of Service govern your use of Pattern, operated by Taphouse Labs, LLC. By creating an account, accessing, or using Pattern, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Pattern. If you are under the age of majority in your jurisdiction, you may use the service only with a parent or legal guardian's consent.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for activity on your account. You agree to provide accurate information and to notify us promptly if you believe your account has been compromised.

3. Service Scope and Acceptable Use

You agree not to:

  • Use the service unlawfully or in violation of others' rights.
  • Attempt unauthorized access to systems or data.
  • Interfere with service operation, security, or performance.
  • Reverse engineer or exploit the service except as allowed by law.

4. Subscription and Billing

Pattern includes a free tier (currently one signal). We may offer a paid annual plan, currently priced at $34.99 USD per year.

  • Paid plans are billed in advance and may auto-renew unless canceled.
  • If purchased through Apple App Store or Google Play, their billing terms also apply.
  • You can manage or cancel renewals through your platform account settings.
  • Refunds are handled under applicable law and platform policies.
  • We may change pricing in the future with advance notice where required.

5. Privacy

Our Privacy Policy explains how we collect, use, and protect personal information and is part of these Terms.

6. Health and Medical Disclaimer

Pattern is a self-tracking and reflection tool. It does not provide medical advice, diagnosis, or treatment. Always seek qualified medical guidance for health concerns. If you have a medical emergency, call emergency services immediately.

7. Intellectual Property

The service, including software, branding, design, and content we provide, is owned by Taphouse Labs, LLC or its licensors and protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Pattern for personal, non-commercial use.

8. Termination

You may stop using Pattern at any time, including by deleting your account from in-app Settings. We may suspend or terminate access if you materially violate these Terms, use the service unlawfully, or create security risk. Sections that by nature should survive termination will remain in effect.

9. Service Availability and Warranty Disclaimer

Pattern is provided on an "as is" and "as available" basis. To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

10. Limitation of Liability

To the fullest extent allowed by law, Taphouse Labs, LLC and its officers, employees, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or use.

Our total liability for claims related to the service will not exceed the amounts you paid us for Pattern in the 12 months before the claim.

11. Indemnification

You agree to indemnify and hold harmless Taphouse Labs, LLC from claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the service, violation of these Terms, or violation of applicable law.

12. Dispute Resolution: Arbitration and Class Action Waiver

Before filing a claim, you and Taphouse Labs, LLC agree to attempt informal resolution by contacting [email protected]. If unresolved after 30 days, disputes will be resolved by binding individual arbitration under the Federal Arbitration Act and AAA Consumer Arbitration Rules.

  • No class actions, class arbitrations, or representative proceedings.
  • Either party may bring qualifying claims in small claims court.
  • Arbitration may proceed in Wake County, North Carolina, or remotely as permitted by AAA rules.
  • You may opt out of arbitration within 30 days of first accepting these Terms by emailing [email protected] with subject line "Arbitration Opt Out."

13. Governing Law and Venue

Except as governed by the Federal Arbitration Act for arbitration matters, these Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. For disputes not subject to arbitration, exclusive venue is in state or federal courts located in Wake County, North Carolina.

14. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice through the app, website, or email. Continued use after an updated effective date constitutes acceptance of the revised Terms.
